The follwing terms, together with other terms, conditions and no-
tices apply to all sales by BoulE S.A.S. in France and will be
applicable to any private sale.
1 in these terms :
1 .1 - " Boule " - The auctioneer BoulE S.A.S. ;
1.2 - " Catalogue "- The catalogue relating to the relevant auction
including any advertisement, brochure, estimate, price list or
other publication including webpage or internet ;
1.3 - " hammer price "- The price in Euros at which a lot is
knocked down by the auctioneer to the buyer ;
1.5 - " lot " - Any item consigned to Boule ;
1.6 - " Buyer’s premium "- Amount payable by the buyer to
Boule in addition to the hammer price ;
1.7 - " vAT "- value Added Tax applicable at the prevailing rate
from time to time ;
1.8 - lots mentionned * are consigned by an extra EEC owner.
Buyers will have to pay the appropriate vAT in addition to the
total price (hammer price + buyer’s premium + taxes if applica-
ble). Extra EEC buyer’s will have the possiblity, in a delay of one
month, to be refunded of this vAT under presentation of the ap-
propriate export license.
2 Boule sells as agent of the seller. Boule shall not be liable for
any act or default by seller or by buyer.
3 Potential buyers are invited to examine before the auction the
lots they are interested in. Boule is at their disposal to supply in-
formations on the condition of the lots.
4 Catalogue descriptions of lots, labels, informations, annonce-
ments and verbal informations by Boule reflect his perception of
the lot and cannot constitute the proof of a fact.
5 indications by Boule concerning a reparation, an accident or
else are only to facilitate the inspection of a lot by the buyer. The
fact that there is no indication of any restoration or accident on
the catalogue, labels, informations, annoncements or verbal infor-
mations by Boule does not implicate there is no default, restaura-
tion or accident on the lot. The indication of one default does not
exclude others.
6 Estimations are indications and are not the guarantee that the
lot will be sold between the low and the high estimation.
7 Potential buyers and bidders are invited to register temselves to
the auction by contacting Boule. identity papers, bank references
or deposit can be requested by Boule.
8 Every bidder take the engagement to personnally and imme-
diatly pay the hammer price, the buyer’s premium and taxes.
Every bidder shall be deemed to act as principal, unless prior to
the commencement of the auction there is a written acceptance by
Boule that the didder acts on the behalf of his principal.
9 Regular way to bid in the auction is to be registered and present
in the saleroom. however Boule offers the possibility to bid by
mail, phone or by internet to any bidder registered and authorized
by Boule. Boule is not responsable if mail is not received or if
connection is of bad quality or impossible. Boule can record com-
munications. in case of equivalent abstentee bids the first recei-
ved will have the priority. in case of equivalent bid between mail,
internet or phone and a bidder in the saleroom, priority will be for
the saleroom.
10 during the auction Boule has the right to refuse a bid, to di-
vide a lot, to assemble two or more lots, to withdraw any lot, to
add a lot and to increase bids as it suits Boule.
11 under the autorithy of the manager of the auction the buyer
will be the person with the highest bid if the hammer price is su-
perior to the minimum price or the reserve. The hammer and the
word «adjugé» or equivalent will close the contract between the
seller and the last bidder.
12 The auction is conducted in Euros. Any indication in an other
currency is an help to the buyers. Boule is not responsable for
change approximations and errors.
13 Buyers will have to pay the hammer price, the taxes and the
buyer’s premium calculated as follows :
14.1. Automobilia : 22% + vAT
14.2. Cars :
under 50.000 € : 18% + vAT
From 50.001 to 500.000 € : 16% + vAT
over 500.000 € : 12% + vAT
14 lots are sold as is. descriptions made by Boule are only indi-
cations. no reclamation can be made after adjudication.
15 Boule considers that the buyers are aware of the documents
concerning the lots. vehicules can be sold without technical
control.
16 it is the buyer’s responsability to take all necessary steps to re-
gister the vehicule to the appropriate entity. The costs are under
the buyer’s responsability.
17 At the end of the auction it is the buyer’s responsability to take
all necessary steps to insure the vehicule. Boule is not responsible
for any loss or degradation.
18 The buyer shall arrange for the removal of the lot in the 24
hours following the auction. The seller shall arrange for the remo-
val of any unsold lot in the 24 hours following the auction. Fai-
lure to remove any lot by the buyer or by the seller will entitle
Boule to charge a removal charge, storage fees, insurance and
other expenses and any costs.
19 French cars of more than 75 years are subjected to an export
license in case the buyer is not from EEC.
20 Payment by the buyer must be made in the 5 working days fol-
lowing the auction even in the case of an export license is neces-
sary.
21 Payment by the buyer must be made to Boule by French
check, bank transfer or cash according to the law.
22 The personal indications indicated in the minutes of sale and
on the tender form are those given by the buyer. Any misrepre-
sentation is the sole responsibility of the buyer.
23 The delivery of the lot will only take place after full payment
of the hammer price, fees and taxes. in case of payment by check
Boule reserves a delay of 8 working days after receipt for the de-
livery. in the absence of payment by the successful bidder and
after formal notice remains unsuccessful, the lot shall be returned
for sale at the request of the seller on the basis of the failure of
the successful bidder. Boule reserves the right to ask the defaul-
ting bidder for interest at the statutory rate plus 5 points, to refund
the costs incurred as a result of default, and to reimburse the dif-
ference between the auction price and the new bid of the resale.
in case of non-payment of the lot this one remains the property of
the seller. Boule can not be asked to substitute itself to the buyer.
24 The French Governement for auctions in France have the right
of preemption.
25 Any transaction subject to these conditions and any related
questions will be regulated by French law and all the parties
concerned will refer to the non exclusive jurisdiction of French
courts for the sales made in France.
26 The reproduction rights of all writing and illustration referring
to the lots will be and will remain at all times the absolute pro-
perty of Boule and may not be used even partially by any person
without the prior written consent of Boule.
27 Boule is an agent of its principal who has authorized him to
sell one or more lots. in this capacity, neither Boule nor the repre-
sentant of the law will be party to the contract binding their prin-
cipal, the seller, to the purchaser; The liability of Boule or the
representant of law can not therefore be sought if one of the par-
ties to the contract does not fulfill any of its obligations.
28 The sale and these conditions are expressly governed by
French law. Any dispute relating to the sale or these conditions
will be submitted to the jurisdiction of the French courts. in case
of conflict between the French version and the foreign language
versions of the conditions, the French version will prevail.
